In accordance with Personal Data Protection Law No. 25,326 and our own self-regulatory policies, through this Privacy Policy, SHARYCO S.A., Tax ID No. 30-71726641-9 (“SharyCo”), wishes to inform all individuals (the “Users”) who use our SharyCo mobile app and the website sharyco.comand/or any other digital platform that may be created in the future (the “Site”) about its personal data protection policy, so that Users may freely and voluntarily decide whether to provide SharyCo with the personal data that may be requested from them or obtained in connection with their access to and use of the Site.
This document forms an integral part of SharyCo’s General Terms and Conditions. By accepting the General Terms and Conditions at the time of registration, the User agrees to the policies set out herein.
SharyCo may modify the terms and conditions of this Privacy and Confidentiality Policy and/or its email practices at any time. If SharyCo decides to make any material changes to this Privacy Policy, Users will be notified by posting an updated version of the Policy in this section, by email, or through notices on the home page or other sections of the Site to keep them informed of the changes made.
If SharyCo makes material changes to the way Personal Data is managed, it will notify Users by email so they can make an informed decision as to whether or not they agree to their Personal Data being used in that manner. If a User does not accept those terms, the contractual relationship will be terminated and their Personal Data will not be used in any manner other than that disclosed at the time it was collected.
Users are hereby informed that the National Directorate for Personal Data Protection, the supervisory authority under Law No. 25,326, is authorized to address complaints and claims relating to non-compliance with personal data protection regulations.
1. PURPOSE AND OBJECTIVE OF COLLECTING PERSONAL DATA
SharyCo collects personal data from Users of the Site (“Personal Data”) through various means, including the Site’s registration form.
Unless otherwise stated, although providing Personal Data to SharyCo is voluntary, failure to provide such Personal Data may affect the quality of the services provided by SharyCo.
Users’ Personal Data is included in an automated SharyCo database for purposes including maintaining an appropriate relationship with Users; facilitating access to the services provided by SharyCo; providing, managing, administering, expanding, and improving the services and/or content offered on the Site; properly responding to any inquiries or requests for information submitted by Users; and, where applicable, sending information about SharyCo’s services or activities that may be of interest to Users.
The database containing SharyCo Users’ Personal Data is hosted by Amazon Web Services. By registering with SharyCo, the User confirms that they have been informed of where this database is hosted and authorizes this international transfer of their data.
Unless the User expressly opts out, SharyCo may send Users advertising and sales-related or other commercial communications. For these purposes, newsletters that SharyCo may occasionally send to Users shall not be considered advertising or sales-related communications.
If the User subsequently wishes to withdraw their consent to receive commercial information by email or any other similar or equivalent means, they may do so by sending an email to info@sharyco.com, without prejudice to their rights of access, rectification, erasure, and objection, which may be exercised in accordance with Section 7 of this Privacy Policy.
2. COOKIES

By accepting this Privacy Policy, the User authorizes SharyCo to use User-related information contained in cookies resulting from the User’s installation and/or use of the Site.
The Site may also include cookies from third-party service and/or content providers. Users may accept or reject the use of cookies; accordingly, SharyCo shall not, under any circumstances, be liable for any processing activities carried out by third parties in relation to Personal Data collected through cookies placed on the Site by those third parties.
3. WEB BEACON
A web beacon is an electronic image, also known as a single-pixel (1 × 1) image or transparent pixel, placed in the code of a web page. A web beacon serves purposes similar to cookies. In addition, web beacons are used to measure user traffic patterns from one page to another in order to optimize how traffic flows through the web. Users and visitors to the SharyCo Site acknowledge and agree that SharyCo may use a tracking system based on web beacons.
4. SPAM
SharyCo and its Users do not tolerate conduct considered “spamming,” whether in opinions, questions, answers, and/or unsolicited emails. The indiscriminate sending of messages of any kind among SharyCo Users is strictly prohibited.
SharyCo may suspend or permanently disable any Users who violate this policy.
5. SERVICES PROVIDED BY THIRD PARTIES
SharyCo may make Personal Data, or part thereof, available to third-party service providers, such as logistics providers, other companies within SharyCo’s corporate group, IT companies, and payment providers, including PayPal, Webpay, Visa, Mastercard, and American Express. These providers may be located in Argentina or in other countries, some of which may not offer a level of protection equivalent to that provided in Argentina, for the proper maintenance and operation of the Site and for processing payments made by Users. Users expressly authorize the transfer of their Personal Data to such third parties for the purposes described above.
If SharyCo decides to disclose or share Personal Data with third parties that are not service providers or SharyCo’s partner, affiliate, or related companies, it will obtain the Users’ consent.
6. INFORMATION SECURITY
SharyCo represents and warrants that it will use its best efforts at all times to maintain the security and confidentiality of Personal Data and will continue to improve the security measures it has adopted in line with legal and technological developments.
SharyCo is required to comply with all applicable regulations regarding security measures for Personal Data. In addition, SharyCo uses industry standards to protect the confidentiality of Personal Data, including firewalls and Secure Socket Layer (“SSL”) technology, among other measures. SharyCo considers Users’ data to be an asset that must be protected against loss and unauthorized access. However, it is important to note that perfect security does not exist on the Internet. Accordingly, SharyCo shall not be liable for unlawful interceptions or unauthorized access to its systems or databases, nor for any improper use of information obtained by such means.
7. USERS’ RIGHTS
Users have the recognized right to access, delete, and update their Personal Data, including their email address, as well as to object to its processing and to be informed of any disclosures made, all in accordance with applicable regulations. As provided in Article 14, subsection 3, of Law No. 25,326, the Personal Data subject, upon verifying their identity, may exercise the right of access within 10 (ten) calendar days of such verification, free of charge and at intervals of no less than six months, unless a legitimate interest is demonstrated. For the rectification and deletion of Personal Data, the data subject may exercise such rights within 5 (five) business days after verifying their identity.
Users guarantee and are responsible, in all cases, for the truthfulness, accuracy, currency, and authenticity of the Personal Data they provide, and undertake to keep such data duly updated.
Once registered with SharyCo, the User may review and change the information submitted during the registration process, including:
- The User’s name and email address. Notwithstanding any changes made, SharyCo will retain the previous Personal Data for security and fraud-prevention purposes.
- Registration information, such as:
- Address, city, region, postal code, primary telephone number, secondary telephone number, fax number, email address, etc.
- CUIT / CUIL tax identification number
- Password.
In certain cases, SharyCo will retain in its records Personal Data that the User has requested to be removed, for the purpose of resolving disputes or claims, identifying and resolving problems or incidents, and complying with the General Terms and Conditions for the period required by law. In any event, a User’s Personal Data will not be immediately removed from SharyCo’s records for legal and technical reasons, including backup systems. Therefore, Users should not expect all Personal Data to be permanently deleted from the databases.
The User may exercise their rights of access, rectification, erasure, and objection to the processing of their Personal Data at any time by submitting a request to the following email address: info@sharyco.com.
8. CONFIDENTIALITY OF INFORMATION
Once registered on the Site, SharyCo will not sell, rent, or share Personal Data except as set out in this Privacy Policy. Notwithstanding the foregoing, the User expressly consents to SharyCo transferring Personal Data, in whole or in part, to any companies controlled by, controlling, and/or affiliated with SharyCo, on any grounds and at such time, in such manner, and under such conditions as SharyCo deems appropriate. SharyCo will use its best efforts to protect the privacy of the information. However, SharyCo may be compelled to disclose information to authorities or third parties under certain circumstances due to court orders or legal requirements. Third parties may also intercept or access certain information or data transmissions; in such cases, SharyCo shall not be liable for any information disclosed.
